THIS PRIVACY NOTICE (“Notice”) describes how BrighterDay Insurance Services LLC, its affiliates and subsidiaries (collectively, “we,” “us,” “our”) collect, use, disclose, and protect personal information in connection with your access to or use of our websites, online services, mobile applications, or any other means by which you engage with us for insurance-related services (collectively, the “Services”). This Notice also addresses your rights and how to exercise them.
This Notice applies to all Services offered by BrighterDay Insurance Services LLC, except those that carry a separate privacy notice that explicitly excludes this one.
1. Who is responsible
BrighterDay Insurance Services LLC is primarily responsible for the personal information we collect and hold in relation to these Services.
2. What personal information we collect
We may collect personal data about you from different sources:
2.1. Information collected directly from you
Depending on the Services you use and in order to provide or maintain our insurance-related services (including Medicare, Medicare Supplement, Medicare Advantage, health insurance, consulting, brokerage), we may collect:
- Personal details: e.g., name, date of birth
- Contact details: e.g., phone number, mobile number, postal address, email address
- Government-issued identification: e.g., Social Security number, driver’s license number, passport number
- Health, medical and policy details: e.g., health certificates, medical conditions, policy numbers/types, coverage information
- Financial information: e.g., bank details, payment information, account numbers
- Employment/occupation information: e.g., current employer, job title
- Online credentials: e.g., username, password, security questions & answers
- Usage data: e.g., your clicks, browsing history, device identifiers, cookies and other tracking technologies
2.2. Information collected from other sources
We may also receive personal information about you from third-party sources, including:
- Insurers, our business partners, other affiliated or non-affiliated entities
- Consumer-reporting agencies (e.g., credit history)
- Public records and other data providers
2.3. Sensitive personal information
In certain cases, we may collect particularly sensitive categories of information, including:
- Health or medical information required to administer your insurance coverage or process claims
- Biometric or disability-related information (where necessary)
- Demographic information (such as race, ethnic origin, gender identity, sexual orientation) for diversity or statutory monitoring purposes
2.4. Children’s Information
Our Services are intended for adults. We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected information of a child under 13, we will delete that information as soon as practicable.
3. How we use your personal information and legal basis
We use your personal information for a variety of purposes, including but not limited to:
- To provide, maintain, service and manage your insurance products and services
- To respond to your inquiries, requests or applications
- To perform system and service administration, record-keeping, reporting and analytics
- To send you marketing communications about products or services we offer (unless you opt out)
- To customize or personalize your experience with our Services
- To comply with our legal or regulatory obligations (e.g., audits, compliance with insurance regulators)
- To protect our rights, the rights of others, and for fraud detection and prevention
In jurisdictions where applicable, we rely on one or more of the following legal bases:
- Performance of a contract with you (e.g., servicing your insurance policy)
- Compliance with a legal obligation
- Our legitimate business interests (provided they do not override your rights)
- Your consent (where required)
4. Your rights and how to exercise them
Subject to applicable law, you may have rights including:
- Access to the personal information we hold about you
- Request correction or amendment of inaccurate data
- Request deletion of your personal information
- Request restriction of our processing of your personal information
- Object to our processing or sharing of your personal information
- Receive a copy of your data in a usable electronic format (data portability)
- Withdraw your consent to processing where that is the basis
- Exercise state-specific rights (e.g., California residents under the California Consumer Privacy Act)
To exercise any of these rights, please contact us as set out in Section 10 below. We may require you to verify your identity before fulfilling your request. We may also refuse requests where an exception applies (e.g., retaining information for legal compliance or defense of claims).
5. Information sharing and disclosure
We may share your personal information as follows:
- With service providers, vendors and business partners who help us operate the Services (e.g., payment processors, email and messaging platforms, insurers)
- With regulators, law enforcement, courts or other governmental authorities where required by law or for regulatory purposes
- In connection with a merger, acquisition or sale of our business or assets (in which case we will take reasonable steps to ensure the transferee uses your information consistently with this Notice)
- With marketing or analytics partners to provide you with tailored marketing, where permitted by law and with your consent (if required)
- We do not sell your personal information to unaffiliated third parties for monetary compensation
6. Information security and retention
We implement appropriate technical, organizational and administrative safeguards to protect the confidentiality, integrity and availability of your personal information. However, no security system is impenetrable and we cannot guarantee absolute security.
We will retain your personal information for as long as needed to fulfill the purposes described in this Notice, comply with legal or regulatory obligations, to resolve disputes, or to maintain audit records. Once we no longer need your information for those purposes, we will securely delete or de-identify it.
7. Cookies, tracking technologies and online advertising
We and our service providers may use cookies, web beacons, device identifiers, and similar technologies to collect usage and device information and for analytics and advertising purposes. You may control cookies through your browser settings, though this may limit certain functionality of our Services.
8. State-specific disclosures
California: If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These include the right to know the categories of personal information collected, the sources, business or commercial purposes for collection, categories of third parties with whom the information is shared, and the right to opt out of the sale or sharing of your personal information. We do not currently “sell” personal information as defined under the CCPA.
Other States: Certain states may require additional disclosures (e.g., “Shine the Light” in California, notice and opt-out rights in other states). We comply with applicable state laws.
9. Changes to this Notice
We reserve the right to modify or update this Privacy Notice at any time, consistent with applicable law. We will post any changes on our website and update the “Last updated” date above. If the changes materially affect how we process your personal information, we will provide you additional notice and an opportunity to review before they become effective.
